SimplBudget Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SimplBudget mobile application and related services (the "Service") operated by SimplBudget ("SimplBudget," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms and our Privacy Policy.


1. Eligibility

You must be at least 18 years old and located in the United States to use the Service. By using the Service, you represent that you meet these requirements.


2. The Service

SimplBudget provides software tools that help consumers understand projected cash flow, Available Margin estimates, and scenario planning based on linked account data and detected recurring patterns.

SimplBudget is not:

The Service provides informational and educational tools only. It does not execute transactions on your behalf unless explicitly stated in a future feature with separate authorization.


3. Account registration

You may sign in using supported identity providers (Apple, Google). You are responsible for maintaining the security of your device and account credentials.

You agree to provide accurate information and notify us of unauthorized access at support@simplbudget.com.


4. Linked financial accounts (Plaid)

To use core features, you may connect financial accounts through Plaid. By connecting an account, you authorize Plaid and SimplBudget to access account information in accordance with our Privacy Policy and Plaid's End User Privacy Policy.

You may disconnect institutions at any time through Connected Accounts. Disconnecting removes linked account and transaction data for that institution from SimplBudget as described in our data retention practices.


5. Subscriptions and billing

Certain features require a paid subscription processed through the Apple App Store (and Google Play where available) via RevenueCat.

Refunds are handled by Apple or Google according to their policies unless otherwise required by law.

8. Intellectual property

The Service, including software, design, trademarks, and content, is owned by SimplBudget or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.


9. Third-party services

The Service integrates third-party services including Supabase, Plaid, OpenAI, RevenueCat, and Apple/Google authentication. Your use of those services may be subject to their terms. SimplBudget is not responsible for third-party services outside our reasonable control.


10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPLBUDGET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT FORECASTS, AVAILABLE MARGIN CALCULATIONS, OR AI EXPLANATIONS WILL BE ACCURATE, COMPLETE, OR ERROR-FREE.


11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPLBUDGET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SIMPLBUDGET IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.


12. Indemnification

You agree to indemnify and hold harmless SimplBudget from claims arising out of your misuse of the Service or violation of these Terms.


13. Dispute resolution and arbitration

Please read this section carefully. It affects your legal rights.

Except where prohibited by law, you and SimplBudget agree that disputes arising out of these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring qualifying claims in small claims court.

Class action waiver: You agree to resolve disputes only on an individual basis and waive any right to participate in a class, collective, or representative action.

You may opt out of arbitration within 30 days of first accepting these Terms by emailing optout@simplbudget.com with your name, account email, and a clear opt-out statement.

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, except where federal law applies.


14. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or other users.

Upon termination, provisions that by their nature should survive (including disclaimers, limitations of liability, and dispute resolution) will survive.


15. Changes

We may modify these Terms. We will post updated Terms with a revised effective date. Continued use after changes constitutes acceptance where permitted by law.
